The government has released proposals today for the creation of a new appeals system for Adult Social Care. The consultation also consults upon the details of the new Cap on Care. The consultation is open from 4th February 2015 until 30th March 2015.
The governments new appeal system comes from and ammendment to the Care Act 2014 which allowed for the creation of an appeal system. There was no detail or specification as to what the appeal system should consist of and so the department of health has been putting together the proposals.
The government are proposing what is effectively the ability for those with problems with their Adult Social Care to be able to request that the matter is considered by what they term as an independant reviewer. The reveiwer would be employed by the same local authority and managed by the same local authority that the person would be appealing against.
The proposed system would put in place time constraints in relation to appeals as well as the possibility of a meeting with the independant review but only if the reviewer came to the conclusion that it was nessesary.
The Disability Law Service will be publishing its response to the consultation on this website shortly and would urge anyone reading this to respond to the consultation.
